Thực hiện quy định của Luật Ký kết, gia nhập và thực hiện điều ước quốc tế năm 2005, Bộ Ngoại giao trân trọng thông báo:

Nghị định thư sửa đổi Bản Thỏa thuận thương mại gạo năm 2010 giữa Chính phủ nước Cộng hòa xã hội chủ nghĩa Việt Nam và Chính phủ nước Cộng hòa Phi-líp-pin, ký tại Ma-ni-la ngày 06 tháng 01 năm 2014, có hiệu lực kể từ ngày 06 tháng 01 năm 2014.

Bộ Ngoại giao trân trọng gửi bản sao Nghị định thư theo quy định tại Điều 68 của Luật nêu trên./.

BETWEEN THE GOVERNMENT OF THE SOCIALIST REPUBLIC OF VIET NAM AND THE REPUBLIC OF THE PHILIPPINES TO AMEND THE 2010 MEMORANDUM OF AGREEMENT BETWEEN THE GOVERNMENT OF THE SOCIALIST REPUBLIC OF VIET NAM AND THE REPUBLIC OF THE PHILIPPINES ON THE SUPPLY OF VIETNAMESE RICE TO THE PHILIPPINES

THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES AND THE GOVERNMENT OF THE SOCIALIST REPUBLIC OF VIET NAM

(hereinafter referred to as ‘Party’ or collectively as “Parties”)

RECALLING the Memorandum of Agreement by and between the Government of the Republic of the Philippines and the Government of the Socialist Republic of Viet Nam on the Supply of Vietnamese Rice to the Philippines (hereinafter referred to as the 2010 MOA) signed on 30 December 2010 in Manila, Philippines;

NOTING that Article 7 of the 2010 MOA provides that the MOA “shall expire on the 31^st of December 2013;”

CONSIDERING that the Parties desire the extension of the 2010 MOA, in order to further enhance and strengthen the good economic relations between the two countries and to ensure stability of supply of rice and to cushion the adverse effects of climate change, pest infestation, drought, floods, and other calamities that are being experienced and may hereafter be experienced globally;

CONSIDERING further that there is a need to cooperate on monitoring and coordination of rice shipments in prevent smuggling of rice;

HAVE AGREED TO THE FOLLOWING PROTOCOL TO AMEND THE 2010 MOA:

ARTICLE 1:

Article 1 of the 2010 MOA is amended, as follows:

The Viet Nam Government agrees to sell, unless under circumstances of natural disaster and harvest loss, and the Philippine Government agrees to buy, depending on its needs, up to 1,500,000 (One Million Five Hundred Thousand) metric tons of Vietnamese while rice annually from the year 2011 to 2016, subject to prevailing international price at the time of purchase.

ARTICLE 2:

Article 5 of the 2010 MOA is amended, as follow:

Both the Parties shall cooperate to take strict measures with Government agencies to stop illegal rice trading between both countries as it adversely affects both rice markets. The Parties shall cooperate in the monitoring and coordination of rice shipments to prevent rice smuggling.

ARTICLE 3:

Article 7 of the 2010 MOA is amended, as follows;

This Memorandum of Agreement shall enter into force from the date of signing and shall expire on 31^st December 2016. Either Party may notify the other of its desire to terminate, suspend of extend this Memorandum of Agreement through six (06) months prior written notice.

Termination of this Memorandum of Agreement shall not affect the validity of the term of any existing contracts already entered into under this Memorandum of Agreement.

ARTICLE 4:

This Protocol shall become effective upon signing.
